OBJECTIVE / SCOPE

 

In accordance with the provisions of Decree-Law 24/2014, of 14 February, these General Terms and Conditions are intended to regulate and are fully applicable to the conclusion and formalization of any contract for the purchase and sale/ordering of FILIGRANA-TE products and articles, which is made by any consumer (hereinafter referred to as the "Customer") through the website www.filigrana-te.com (hereinafter referred to as the "Site") in Portuguese territory.

The presentation, sale and supply of Filigrana-te products and articles through this website is, under all circumstances, carried out by the company Carina Cruz Gonçalves - Unipessoal, Lda., (hereinafter referred to as CCG - Unip., Lda.) headquartered at Rua de Penelas, n.º 140, 4850-194 Braga, with the NIPC: 516245287.

Any Customer may contact us to request clarification, ask questions or make suggestions or complaints by the following means:

• Chat available on any page of the site (Monday to Friday from 9am to 6pm);

• Send an e-mail to the following address: filigranatebycg@outlook.pt.

The Customer acknowledges that the conclusion of a particular order through the website determines full and unconditional acceptance of these General Terms and Conditions, which must be read and expressly confirmed by the Customer when concluding any order. The contents of these General Terms and Conditions are, at all times, available for printing and storage by Customers.

CCG - Unip., Lda. reserves the right to make any changes to these General Terms and Conditions at any time and without prior notice. These changes will, however, only apply to sales contracts / orders that are formalized after these changes have been published on the website.

Contracts will only be made with Clients who are of legal age and have full legal capacity.

 

 

INFORMATION ON FILIGREE PRODUCTS AND ARTICLES

 

All FILIGRANA-TE products presented and sold through the website are catalogued in detail in the respective sections of each of the categories, novelties or collections, and the respective characteristics can be viewed in the "Product Description" field of each of the articles or products made available.

CCG - Unip., Lda. will make every effort to ensure that the products presented and marketed on the site are available for purchase by the Customer and that products and references with existing stock are available for viewing. Without prejudice to the foregoing, in the event of stock shortages of any of the products presented and the consequent impossibility for the Customer to immediately purchase the desired product, this information will be communicated to the Customer upon completion of the order, as described in field no. 5 "Order Confirmation" of these General Terms and Conditions of Sale.

The price indicated for the products is the unit value at which CCG - Unip., Lda. sells its articles and products through the website, which includes all applicable taxes. The price corresponding to postal deliveries, which will be added to the price of the product or items purchased, must be borne by the Customer and is shown immediately before the order is completed.

 

 

PURCHASING PROCEDURE

 

In order to purchase a certain product through the site, the Customer must register in advance by providing and entering the requested data and, after confirming registration, access the site by entering the respective data.

Once they have entered their details, customers can choose all the items or products they wish to purchase by clicking on the "Add to Cart" box and indicating the number of units they want, as well as some characteristics (color, size, etc.) in the case of some items.

After adding all the products they wish to purchase to the "Cart", the Customer must access it, where all the items and products selected and added will be displayed.

The Customer may, if they wish, delete one or more products added to the "Cart" by clicking on the corresponding command.

In order to complete the current order, the Customer must enter the data requested in each of the steps presented, relating to the order, invoicing, shipment and payment.

Entering incorrect or incomplete data will prevent the order from being processed and completed, and CCG - Unip., Lda. will not be liable for any damages arising from such acts.

Once the requested data has been entered correctly, the Customer must carefully check the "Summary" of their order, which will be made up:

• For all items to be purchased and added to the "Cart";

• For the amount to be paid by the Customer for the selected items;

• For the cost of postal delivery of the items to be purchased;

• For the total value of the order, which will result from the sum of the items purchased and the value applicable to the postal delivery of said products.

If the "Summary" presented corresponds to the items desired and if the Customer agrees with the overall value presented, he/she must, if he/she so wishes, expressly accept these General Terms and Conditions and Privacy Policy.

Once this has been verified and accepted, the Customer must complete and validate their order by clicking on the "Buy" box, and the Customer acknowledges that this validation constitutes the formalization of the contract for the purchase and sale of the items in question.

All orders placed can be viewed and consulted in the "Customer Area", in the "My Orders" field.

After payment of the total amount of the order has been made, the Customer may exercise their right of withdrawal as provided for in point 8 of these General Terms and Conditions.

 

 

PAYMENT / INVOICING

 

Customers can pay for their orders by bank transfer or MBWAY, using the details sent to them after confirmation of the order.

CCG - Unip., Lda. guarantees total security and confidentiality of the data corresponding to the payment method used.

The invoice to be issued will take into account the information provided by the Customer and will itemize the prices of the products purchased, the value of the postage and the applicable VAT, and in any case it will not be possible to alter the data contained therein.

If payment is not made within 48 hours of confirmation of the order, the order will be canceled.

 

ORDER CONFIRMATION

 

In accordance with point 3 above, the completion and validation of the order takes place when the Customer clicks on the "Buy" field, acknowledging for all intents and purposes that, without prejudice to the confirmation e-mail that will be sent by CCG - Unip., Lda. within 24 hours, such validation constitutes the formalization of the purchase and sale contract for the items in question.

This confirmation e-mail will indicate the order number that the Customer must use in any communication they wish to have with CCG - Unip., Lda. The Customer also undertakes to check that the data / products contained in the order are correct and to indicate any changes or inaccuracies in good time. Any charges arising from inaccuracies not reported in good time shall be borne exclusively by the Customer.

The Customer may view all orders placed in their "Personal Area" or contact CCG - Unip., Lda. by the means already mentioned in point 1 for this purpose.

In the event that one or more of the products ordered by the Customer is not available, CCG - Unip., Lda. will notify the Customer of its unavailability:

• If the order submitted contains only one reference and it is not in stock, CCG - Unip., Lda. will cancel the order and refund the amount;

• If the order contains two or more items and one of them is not available, CCG - Unip., Lda. will confirm and send the available items and refund the amount paid for the unavailable item.

 

 

SHIPPING AND DELIVERY

 

The order is sent via the CTT transport company, with delivery as follows:

• Home delivery - When your order is dispatched, you will receive an e-mail and SMS notification indicating the estimated delivery date and tracking code. As a rule, the order will be transported and delivered by CTT, and the respective proof of receipt must be signed by the Customer. If the Customer is not at the address indicated by the Customer for receipt of the order, an acknowledgement of receipt will be left in the mailbox which the Customer will have to use to pick up the order at the CTT branch mentioned in the acknowledgement (usually the CTT office in the area to which the Customer requested the shipment).

Upon delivery of the order and prior to signing the respective proof of receipt, the Customer must check that it contains all the products and items purchased, the Customer acknowledging that said signature constitutes, for all legal purposes, confirmation of the proper receipt of all the items purchased and in accordance with the order placed.

Shipping costs are the responsibility of the Customer.

The order will be delivered between 2 and 14 working days in mainland Portugal and the archipelagos, provided payment has been made by 2pm on the day the order is submitted.

During the current situation of restrictions imposed by COVID-19, the deadline for deliveries may be longer.

 

 

PROMOTIONS / OFFERS

 

CCG - Unip., Lda. promotes different types of promotions or discount sales through the site under certain circumstances.

Said promotions and discounts will be subject to the conditions expressly indicated for each individual promotion, as well as to these general terms and conditions of sale, with the Customer acknowledging that in the event of a conflict, the rules applicable to the specific conditions of the promotion will prevail.

If the advertised promotion is aimed at offering a good or product and the Customer exercises their right to withdraw or return the purchased item, this will also entail the return of the offer item.

The offers received may not be sold or transferred to third parties by the Customer with the intention of obtaining, directly or indirectly, an economic profit.

The Customer may waive the free offer, but may not claim or obtain any compensation for waiving it.

During promotional campaigns, sales periods and Black Friday actions at FILIGRANA-TE, orders are considered to be within a campaign once payment has been made and provided that it is made within a maximum period of 24 hours of placing the order within the dates defined for the campaign period, i.e. before the end date of the promotion. Delivery times for orders during promotional campaigns may be subject to delays.

 

 

RETURNS

 

Customers who purchase any FILIGRANA-TE product through the website may exercise their right of withdrawal under the terms of article 11 of Decree-Law 24/2014, of February 14.

The right of withdrawal provided for in the previous paragraph must be exercised within a maximum period of 14 days from the date of receipt of the order by the customer, by communicating your intention to the e-mail address filigranatebycg@outlook.pt.

In the event of termination, the Customer must keep the items and products purchased so that they can be returned to CCG - Unip., Lda. within 14 days of receipt.

Returns made by the Customer under the right of withdrawal must be sent by post (CTT) to the address Rua de Penelas, n.º 140, Guilhofrei, 4850-194 Braga, and the costs associated with the shipment are the responsibility of the Customer.

The item must always be accompanied by the invoice, and returns will only be accepted for items in the same condition as they were sent and without any sign of use, with all the wrapping props that were sent (boxes, bags, cards, etc.).

Once the right of withdrawal has been exercised under the terms of numbers 1, 2 and 3 above, CCG - Unip., Lda. will refund the price paid to the customer without any costs or expenses for the customer, and the refund will be made using the same payment method. If there are previous transportation costs, these will not be included.

AFTER-SALES SERVICES

 

All items sold by CCG - Unip., Lda. are covered by the brand's 2-year manufacturer's warranty. After the warranty expires, CCG - Unip., Lda. also provides technical assistance. Defective or faulty products should be reported to filigranatebycg@outlook.pt as soon as possible. Whenever the repair involves costs for the customer, it will only be started once the quote has been accepted by the customer.

 

 

PRODUCT WARRANTY

 

Under the terms of Decree-Law no. 67/2003, of April 8, as amended by Decree-Law no. 84/2008, of May 21, all FILIGRANA-TE products are covered by a 2 (two) year guarantee of conformity.

During the warranty period, any product with a manufacturing defect will be repaired free of charge or replaced with a similar model.

In cases where it is not possible to repair the product, the Customer will have to present the non-conforming good, together with the original of the respective warranty certificate duly and completely filled in (indicating the date of purchase, name and address of the merchant and the reference assigned to the good - where applicable - or product designation) and the purchase invoice or other suitable proof of purchase.

Materials subject to breakage (e.g. murano beads, crystals, pendants and sapphire glass), loss, theft, deterioration, oxidation, defects caused by knocks, including deformations caused by daily and/or inappropriate use (e.g. rings, slaves and creased meshes) are excluded from the guarantee.rings, slaves and creased meshes), improper care and cleaning, negligence, improper handling, modifications to the original product, repairs not authorized by the brand, accidents or normal wear and tear, as well as damage caused by the use of other non-FILIGRANA-TE products associated or together with them.

 

 

PRICING POLICY

 

The prices shown for each item/product include VAT at the legal rate. 

The price of each item/product will be the one displayed on the Site at any given time, except in the event of an obvious error, namely an editing error, insertion error or software error. If an error is detected in the display of the price of a particular item that has been ordered by the Customer, Filigrana-te reserves the right to revoke/cancel that order, while giving the Customer the opportunity to complete the purchase at the correct price, subject to stock availability.

In the event of revocation/cancellation of the purchase made by Filigrana-te, the latter will immediately refund the amount paid by the Customer.  

Filigrana-te will therefore not be bound to supply any product whose displayed price is in manifest error.

CCG - Unip., Lda. reserves the right to change the prices and/or characteristics of products and services without prior notice.

PROCESSING OF PERSONAL DATA

 

In compliance with Law no. 67/98 of October 26, on the Protection of Personal Data, we hereby inform you that the processing of personal data collected on the www.Filigrana-te.com website is the responsibility of CCG - Unip., Lda.

The data collected on the site is intended solely for processing orders and communicating with Customers, processing requests for information and any complaints.

CCG - Unip., Lda. guarantees the confidentiality of all data provided by its clients, warning that, although CCG - Unip, Lda. collects and processes data securely and takes all technical measures to prevent its loss or manipulation, the data is collected over an open network, which may allow the personal data provided to circulate, as well as its use and viewing by unauthorized third parties, and CCG - Unip., Lda. will not be held responsible for any damage caused.

CCG - Unip., Lda. grants the Client, at all times, the right to access, rectify or delete their personal data, as well as the right to object to the processing of said data, by means of a written request that must be sent to the email address or address indicated above.

 

 

INTELLECTUAL AND INDUSTRIAL PROPERTY

 

All texts, comments, works, illustrations, works and images reproduced or represented on the www.Filigrana-te.com website are duly protected by their respective copyrights, worldwide. Accordingly, and under the terms of the Copyright and Related Rights Code, their use is only authorized for private purposes, without prejudice to more restrictive provisions contained in the aforementioned Code. Any total or partial reproduction or representation of the www.Filigrana-te.com website or of all or part of the elements included in it is strictly prohibited, under penalty of recourse to the competent legal means against anyone who acts in this way.

The company names, trademarks and any distinctive signs reproduced on the www.Filigrana-te.com website are protected under the terms of the legal provisions applicable to industrial property. The reproduction or representation of all or part of these distinctive signs is strictly prohibited and must be subject to prior written authorization from the respective owners.

The law applicable to any contractual relationship established through the CCG - Unip., Lda. website is Portuguese law.
